Today, the Ohio Supreme Court issued a groundbreaking decision in the case State of Ohio v. Antwuan Smith (PDF) requiring law enforcement have a warrant in order to search the contents of someone’s cell phone. This marks the first time a state supreme court has ruled on this issue.

Perhaps what is most encouraging about the ruling is the Ohio Supreme Court’s recognition that cell phones are much different than previous items that courts have allowed law enforcement to search without a warrant. Indeed, today’s modern cell phone is not simply used to make and receive phone calls. For many of us, it may be where we access the internet, manage our finances, maintain personal contact information, or where we store private photos. As a result, people have a much higher expectation that this information will remain private. If police were able to have unfettered access to cell phones without a search warrant, unimaginable amounts of personal data would be subject to government scrutiny.

The Court did outline two narrow exceptions where police could conduct warrantless searches: if it was necessary to protect the safety of officers, and if they believed the individual may delete evidence. However, in the second circumstance, the Court said the officers may only seize a cell phone to prevent the destruction of evidence. They did not give officers permission to search the phone prior to receiving a search warrant.

Oftentimes, the law struggles to keep up with the breakneck pace of technology. It is doubtful that the framers of our Constitution anticipated the advent of computers or the internet, but that should not mean the basic principles our nation were founded on apply any less.
While this ruling is significant today, it will also have an important impact in the future. It is only a question of when — not if — there will be new technology and questions arise over whether the government may access personal information. This decision has reinforced that while technology may change rapidly, our core civil liberties do not.

Former Republican Speaker of the House Newt Gingrich was on NBC’s Meet The Press today, and he gave the strongest indication yet that the GOP strategy for 2010 and 2012 is to run against the healthcare bill. He said, “I suspect every Republican running in '10 and again in '12 will run on an absolute pledge to repeal this bill.”

Gingrich said, “Well, you've got $513 billion in tax increases, $470 billion in Medicare cuts. You have a scale of, I think, bribery in the Senate we have not seen in our lifetime, with various senators getting all sorts of special deals in a way that I think the public is just appalled by. I suspect every Republican running in '10 and again in '12 will run on an absolute pledge to repeal this bill. The bill--most of the bill does not go into effect until '13 or '14, except on the tax increase side; and therefore, I think there won't be any great constituency for it. And I think it'll be a major campaign theme. This is a bad bill, written in a horrible way, and the most, the most corrupt legislation I've seen in my lifetime.”

Sales of U.S. New Homes Unexpectedly Fell in November (Update2) -

Purchases of new homes in the U.S. unexpectedly fell last month, indicating a recovery from the worst housing slump since the Great Depression will be slow to develop.
Dec. 23 (Bloomberg) -- Purchases of new homes in the U.S. unexpectedly fell last month, indicating a recovery from the worst housing slump since the Great Depression will be slow to develop.

Purchases dropped 11 percent to an annual pace of 355,000, lower than the lowest estimate of economists surveyed by Bloomberg News, figures from the Commerce Department showed today in Washington. The median sales price decreased 1.9 percent from November 2008.

The prospect that a government tax incentive would expire, combined with a 10 percent jobless rate and competition from foreclosed properties may have hurt builders such as Beazer Homes USA Inc. Last month’s decrease signals a sustained housing recovery may be difficult to secure without additional assistance from policy makers.

“The tax credit put a Band-Aid over the housing problem and in October and November we ripped it off” as it was set to expire, said Mark Vitner, a senior economist at Wells Fargo Securities LLC in Charlotte, North Carolina, who projected sales would fall. “Demand for housing is not likely to pick up on a consistent basis until we start to see some improvement in employment.”

Stocks dropped following the report, erasing earlier gains. The Standard & Poor’s 500 Index was little changed at 1,116.97 at 10:25 a.m. in New York. The S&P Homebuilder Supercomposite was down 0.2 percent.

Unexpected Drop

Sales were projected to climb to a 438,000 annual pace from an originally reported 430,000 rate in October, according to the median estimate in a Bloomberg survey of 72 economists. Forecasts ranged from 400,000 to 460,000.

Consumer spending increased in November less than anticipated as Americans cut back on services after buying more autos and electronics, others figures from the Commerce Department also showed. The 0.5 percent increase in purchases was the sixth gain in the past seven months and followed a 0.6 percent increase in October.

The report also showed incomes climbed 0.4 percent, the biggest increase since May, and inflation cooled.

Fewer job losses and discounts may be brightening consumers’ moods. A measure of household confidence increased in December for the first time in three months, another report showed. The Reuters/University of Michigan final index of consumer sentiment climbed to 72.5, less than anticipated, from 67.4 in November. The figure was lower than the preliminary 73.4 reading, reported on Dec. 11.

Lower Prices

The report from the Commerce Department showed the median price of a new home in the U.S. decreased to $217,400, from $221,600 a year earlier.

Sales of new homes were down 9 percent from November 2008.

Construction cutbacks helped bring inventories down. The number of homes for sale fell to a seasonally adjusted 235,000, the fewest since April 1971. The supply of homes at the current sales rate increased to 7.9 months’ worth.

New home purchases, while accounting for less than 10 percent of the housing market, are considered a timely indicator because they are based on contract signings. Sales of previously owned homes, which make up the remainder, are compiled from closings and reflect contracts signed weeks or months earlier.

Sales of existing homes in November rose 7.4 percent to a 6.54 million annual rate, the highest level in almost three years, the National Association of Realtors said yesterday. Foreclosures accounted for 33 percent of all sales, while 51 percent were to first-time buyers, NAR said.

Plunge in South

Sales dropped in three of four regions last month, led by a 21 percent plunge in the South that took purchases in that area down to the lowest level since 1991. The Midwest showed the only increase, gaining 21 percent.

President Barack Obama and Congress extended an $8,000 first-time buyer credit and expanded it to include current homeowners in a bid to boost demand. Still, the measure may have pulled sales forward and could result in fewer purchases in coming months.

The Federal Reserve last week signaled it would keep lending rates low for “an extended period” to foster growth. The average rate on a 30-year fixed mortgage was 4.94 percent last week and has averaged 4.85 percent since the end of October, according to Freddie Mac.

“The housing sector has shown some signs of improvement over recent months,” Fed policy makers said in their statement. “Household spending appears to be expanding at a moderate rate, though it remains constrained by a weak labor market, modest income growth, lower housing wealth, and tight credit.”

Record Foreclosures

Record foreclosures are also restraining housing by driving down prices. Foreclosure filings in the U.S. will reach a record for the second consecutive year with 3.9 million notices sent to homeowners in default, RealtyTrac Inc. said on Dec. 10. This year’s filings will surpass 3.2 million for all of 2008, the Irvine, California-based company said.

Homebuiilders remain cautious. Atlanta-based Beazer last month said orders rose 2.4 percent in the fourth quarter, and early debt repayment contributed to its first quarterly profit in three years.

“We experienced some moderation in negative market trends,” Chief Executive Officer Ian McCarthy said in a statement. “Elevated unemployment and rising foreclosure activity make it difficult to predict when and to what extent the housing market will sustainably recover.”

Chinese archaeologists believe they have found a nearly 1800-year-old tomb belonging to the legendary ruler Cao Cao, who was known as a cruel tyrant but also a cunning military strategist and poet.

The tomb is located in central Henan province, not far from the Yellow River and near the city of Anyang, where Cao Cao ruled the Kingdom of Wei from 208 to 220, when he died at age 65, the state China Daily reported on Monday.

"Excavation has been going on for nearly one year, and we'll come up with further evidence," the paper quoted Guan Qiang of the State Administration of Cultural Heritage as saying.

"But even based on what we've got, we can tell for sure that the mausoleum belongs to Cao Cao."

Numerous articles found in the tomb are inscribed as "personal belongings frequently used by the King Wu of Wei," Cao Cao's posthumous title, it said.

Archaeologists have found the remains of three people in the tomb - a male around 60 years of age, believed to be Cao Cao, a female of about 50 and a second woman between 20 and 25, thought to be the king's wife and escort.

The tomb was discovered about a year ago, but only became known to authorities after stone tablets carrying inscriptions of "King Wu of Wei" were seized from alleged tomb raiders, the report said.

So far archaeologists have recovered over 250 relics from the tomb which covers an area of 740 square metres, an area befitting a burial plot for someone of Cao Cao's stature, it said.

During his rise to power during the waning years of the Han Dynasty, Cao Cao became known as a clever yet cruel tyrant who was also a military genius.

His exploits form an important aspect of the 14th century historical novel Romance of the Three Kingdoms, known as one of China's greatest literary works and a publication that remains widely read today.

Cao Cao remains a mainstay in Chinese culture and is a frequent character in Peking opera and historical theatre. He was most recently portrayed in director John Woo's blockbusters Red Cliff and Red Cliff 2.

His poems continue to be taught in schools throughout China.

North Korea 'detains' US missionary

North Korean border guards apparently detained an American missionary when he walked into the communist nation in an effort to call attention to Pyongyang's human rights abuses, an activist said.

Robert Park, 28, slipped across the frozen Tumen River into the North from China on Christmas Day carrying a letter calling on North Korean leader Kim Jong Il to shut the country's political prison camps.

There has been no word from him since.

Jo Sung-rae of the Seoul-based activist group Pax Koreana cited a person who witnessed Park crossing into the North as saying that voices were heard on the North Korean side as soon as Park crossed over.

Jo quoted the person, one of two people who guided Park to the crossing, as saying visibility was poor. "But he said he heard people talking loudly when Robert arrived there," Jo added. "I think they were border guards and Robert was taken into custody immediately."

Members of Park's church in Tucson, Arizona, held services on Saturday and Sunday night to pray for his safe return, said the Reverend John Benson, the pastor at Life in Christ Community Church. About 70 people attended Saturday's vigil, he said.

Park's father, Pyong Park, quoted his son as saying before the journey he was "not afraid to die, as long as the whole world, all every nation pay attention to the North Korea situation, my death is nothing". The senior Park spoke to San Diego's KFMB television.

Jo said two guides, whom he described as North Korean defectors, filmed Park's crossing. But one of them is demanding payment for the footage and is refusing to hand it over.

Jo, who has been the source of most information about Park, initially requested anonymity, citing the sensitivity of the situation, but has now agreed to be named.

North Korea's state-run media has been silent on Park's case. The US State Department and the US Embassy in Beijing said they were aware of the incident but had no details.

Park, who is of Korean descent, was carrying a letter urging leader Kim Jong Il to step down and free all political prisoners, the activist said.

"I am an American citizen. I brought God's love. God loves you and God bless you," Park said in Korean as he crossed over near the northeastern city of Hoeryong, according to Jo.

Park was holding a Bible in his right hand and a piece of paper printed with a hymn text in the other, Jo said.

Park's crossing comes just months after North Korea freed two US journalists who had been arrested in March and sentenced to 12 years of hard labour for trespassing and "hostile acts".

Pyongyang dexterously used their detention as a negotiating card with Washington amid a standoff over its nuclear programs.

North Korea waited four days before announcing on March 21 that they had been detained.

Former President Bill Clinton visited Pyongyang in August to bring them home. That trip, which included a meeting between Clinton and Kim Jong Il, led to the first high-level talks between the two countries earlier this month since US President Barack Obama took office.

North Korea watchers in Seoul, however, said Park's case was unlikely to develop in the same way.

A Nigerian man who said he was an agent for al-Qaida tried to blow up a Northwest Airlines plane Friday as it was preparing to land in Detroit, but travelers who smelled smoke and heard what sounded like firecrackers rushed to subdue him, the passengers and federal officials said.

Flight 253 with 278 passengers and 11 crew members aboard was about 20 minutes from the airport when passengers heard popping noises, witnesses said. At least one person climbed over others and jumped on the man. Shortly afterward, the suspect was taken to the front of the plane with his pants cut off and his legs burned, a passenger said.One U.S. intelligence official said the explosive device was a mix of powder and liquid. It failed when the passenger tried to detonate it.

"It sounded like a firecracker in a pillowcase," said Peter Smith, a traveler from the Netherlands. "First there was a pop, and then (there) was smoke."Smith said a passenger sitting opposite the man climbed over people, went across the aisle and tried to restrain the man. Syed Jafri, another passenger, said he saw a glow and smelled smoke. Then, he said, "a young man behind me jumped on him.""Next thing you know, there was a lot of panic," said Jafri. Smith said the heroic passenger appeared to have been burned.

The White House said it believed it was an attempted act of terrorism and stricter security measures were quickly imposed on airline travel. It did not specify what those were.

The incident was reminiscent of Richard Reid, who tried to destroy a trans-Atlantic flight in 2001 with explosives hidden in his shoes, but was subdued by other passengers. Reid is serving a life sentence.

Law enforcement officials identified the suspect in Friday's attempted attack as Umar Farouk Abdul Mutallab. One law enforcement official said the man claimed to have been instructed by al-Qaida to detonate the plane over U.S. soil. All the officials spoke on condition of anonymity because the investigation was continuing.

The man was being questioned Friday evening. An intelligence official said the Nigerian passenger was being held and treated in an Ann Arbor, Mich., hospital. One passenger was taken to the University of Michigan Medical Center in Ann Arbor, hospital spokeswoman Tracy Justice said. She referred all inquiries to the FBI.

The trauma burn center at the hospital said it did not have Abdul Mutallab in its unit.Flight 253 began in Nigeria and went through Amsterdam en route to Detroit, said Rep. Peter King, R-N.Y., the ranking GOP member of the House Homeland Security Committee.

A spokeswoman for police at the Schiphol airport in Amsterdam declined comment about the case or about security procedures at the airport for Flight 253. Schiphol airport, one of Europe's busiest with a heavy load of transit passengers from Africa and Asia to North America, strictly enforces European security regulations including only allowing small amounts in hand luggage that must be placed inside clear plastic bags.

There was nothing out of the ordinary about the flight until it was on final approach to Detroit, said Federal Aviation Administration spokeswoman Elizabeth Isham Cory. That is when the pilot declared an emergency, she said. The flight landed at 12:51 p.m. EST, she said.

Delta Air Lines Inc., which bought Northwest last year, said that "upon approach to Detroit, a passenger caused a disturbance." It said the passenger was subdued immediately and the crew asked that law enforcement officials meet the flight."The passenger was taken into custody and questioned by law enforcement authorities," the airline said.

According to the airline, eight flight attendants and three pilots were on board.Smith said while he was leaving the plane, he looked at where the man had been sitting and saw a pillow that seemed to have been burned. Melinda Dennis, who was seated in the front row of the plane, said the man involved was brought to the front row and seated near her. She said his legs appeared to be badly burned and his pants were cut off. She said he was taken off the plane handcuffed to a stretcher. President Barack Obama was notified of the incident and discussed it with security officials, the White House said. It said he is monitoring the situation and receiving regular updates from his vacation spot in Hawaii.

Federal officials said there would be heightened security for both domestic and international flights at airports across the country, but the intensified levels would likely be "layered," differing from location to location depending on alerts, security concerns and other factors.

Passengers can expect to see heightened screening, more bomb-sniffing dog and officer units and behavioral-detection specialists at some airports, but there will also be unspecified less visible precautions as well, officials said.

The FBI and the Homeland Security Department issued an intelligence note on Nov. 20 about the threat picture for the holiday season, which was obtained by The Associated Press. At the time, officials said they had no specific information about attack plans by al-Qaida or other terrorist groups.

In 2003, al-Qaida leader Osama bin Laden purportedly marked Nigeria for liberation in a recording posted on the Internet, calling on Muslims in the oil-rich country to rise up against one of the "regimes who are slaves of America." But links to al-Qaida remained rare, though security forces claimed to break up such a linked terror cell in November 2007.

Security at Nigeria’s two major international airports in the capital Abuja and in its megacity Lagos remains a point of concern. Uniformed federal police officers often focus their time on keeping hagglers and taxi drivers out. Bags quickly pass through X-ray scanners and those watching incoming passengers do not typically conduct tests for explosive residue on passengers’ carry-on baggage or shoes. At the gate, airline workers often check passengers again with handheld metal detectors before they board their flight.

Delta, which is days away from obtaining a single operating certificate from the FAA to fully integrate itself and Northwest, has been hosting military personnel who have to travel over the holidays in a lounge at the Detroit airport. ___

I previously presented articles and videos regarding the Queen of England owning the United States, which I did so to obtain your reactions. To the contrary, the Queen of England does not own the United States of America nor ever loaned money.

Going back over many centuries, when one dynasty was taken over by another, the previous would hide their sovereign wealth (gold, precious stones, etc.) in mountain caves and elsewhere; ultimately, when Western nations began onslaught into China, much of this wealth was off-shored in part, by establishing new banking structures (e.g., Citibank was established initially with this offshore sovereign wealth): we're talking in the multi-multi-trillions. Over subsequent centuries, this all sat idle in interest bearing accounts, and these accumulated to the multi-trillions. Judge Allows Wild Horse Roundup in Nevada

The Obama administration said Wednesday it is going forward with a contentious plan to round up about 2,500 wild horses in Nevada.

A spokeswoman for Interior Secretary Ken Salazar said herds in the Calico Mountains Complex in northwestern Nevada are overpopulated and need to be reduced to protect the horses and the rangelands that support them.

"The current population in the five Calico herd management areas is three times what the range can handle, so this gather will ensure high-quality habitat for the wild horse and burros and other wildlife while protecting the public rangeland from overuse," said spokeswoman Kendra Barkoff.

She called the dispute over the roundup "yet another clarion call to develop and implement a long-term solution to the challenges we face concerning wild horses and burros on our public lands."

The Interior Department announcement came after a federal judge on Wednesday denied a request to block the roundup, saying opponents had failed to demonstrate that removal of the horses would violate federal law.

U.S. District Judge Paul Friedman said the agency is obligated under a 1971 law to carefully manage wild horse herds to prevent overpopulation.

The mustang roundup planned for Monday would be one of the largest in Nevada in recent years. Officials plan to use helicopters to force the horses into holding pens before placing them for adoption or sending them to long-term holding corrals in the Midwest.

The roundup is part of the land management agency's overall strategy to remove more than 10,000 mustangs from public lands across the West and ship them to greener pastures in the Midwest and East. The Bureau of Land Management estimates about half of the nearly 37,000 wild mustangs live in Nevada, with others concentrated in Arizona, California, Oregon, Utah and Wyoming.

Another 32,000 horses and burros are cared for in corrals and pastures in Kansas, Oklahoma and South Dakota.

Mustang advocates had sued to block the roundup, saying that use of the helicopters is inhumane because some of the animals are traumatized, injured or killed. Opponents also contend that the bureau is grossly inflating horse numbers to justify their removal from the range.

The lawsuit says wild horses are an integral part of the natural ecosystem and should remain on rangeland throughout the West rather than be herded into long-term holding pens.

A state wildlife agency sided with federal land managers, arguing in court papers last week that the mustangs have "severely degraded" the range and adversely affect Bighorn sheep and other wildlife that compete for scarce water resources in the drought-plagued region.

Friedman sided with roundup opponents in one aspect of his 25-page ruling. He said federal officials likely were violating federal law by stockpiling tens of thousands of horses in long-term holding facilities in the Midwest. The judge invited both sides to offer more legal arguments on the issue but said Congress ultimately may have to get involved.

Since the bureau has no money to euthanize the horses and no authority to hold them in a long-term facility, "it would face an inescapable conundrum" in conducting the roundup, Friedman said. The dispute is best solved by Congress, he added.

William Spriggs, a lawyer who argued against the roundup on behalf of California-based In Defense of Animals, said he was disappointed that Friedman allowed the roundup to go forward, but added: "I'm elated the judge at least bought one of our arguments."

Spriggs said President Barack Obama should issue a "holiday reprieve" for the mustangs and block the Nevada roundup until the legality of the long-term holding facilities is decided.

"The BLM's policy of stockpiling tens of thousands of horses in the Midwest — off their rightful Western ranges — is contrary to law, the intent of Congress and the will of the American people," Spriggs said.

Matthew 12: 33- 37

A tree is identified by its fruit. If a tree is good, its fruit will be good.
If a tree is bad, its fruit will be bad. You brood of snakes! How could evil men like you speak what is good and right? For whatever is in your heart determines what you say. A good person produces good things from the treasury of a good heart, and an evil person produces evil things from the treasury of an evil heart. And I tell you this, you must give an account on judgment day for every idle word you speak. The words you say will either acquit you or condemn you.

Jesus reminds us that what we say reveals what is in our heart. What kinds of words come out from your mouth? That is an indication of what is in your heart.

I often tell my daughter to stop and think about what she is going to say first before she says it. How often do we actually do that?

Determine to give your mouth a cleaning! How do we do that? You can't solve your heart problem just by cleaning up your speech, but its a real start to submitting to God; allowing Him to have control of your words. You must allow the Holy Spirit to fill you with new attributes and motives; then your speech will be cleansed at it's source.

James 3: 9-11 Sometimes it praises our Lord and Father, and sometimes it curses those who have been made in the image of God. And so blessing and cursing come pouring out of the same mouth. Surely, my brothers and sisters, this is not right! Does a spring of water bubble out with both fresh water and bitter water?

Ephesians 4: 29 Don't use foul or abusive language. Let everything you say be good and helpful, so that your words will be an encouragement to those who hear them.

God, we want to to control our tongues! We want only words that uplift, encourage, and show others our love and dedication to following Your Word. May others know us by the way we love and the words that come forth from our mouths.

Help us to remember that the same mouths that praise You should not be producing perverse talk, cursing, abusive language, or corrupt speech. Guide us and guard us. Clean out our hearts, O Lord, we pray! May our lips only bring forth words of praise, encouragement, and peace.

Question: Why do Latter-day Saints teach that there are many Gods when the Bible states in Isaiah 44:8: "Is there a God beside me? yea, there is no God: I know not any." While it is true that Mormonism accepts the Biblical teaching that there are many Gods, it is equally true that it teaches there is but one Godhead which rules and directs the affairs of this earth. It is comprised of God the Father, his son Jesus Christ, and the Holy Ghost.

In that Godhead, as Jesus clearly and repeatedly taught, God the Father hold ultimate power and control of earthly events. Jesus Christ serves as his executive to carry out his instructions and divine will. This relationship was clearly and repeatedly taught by the Savior during his mortal ministry (see Jn. 4:34; 5:17-20, 22-27, 30-36; 6:29, 38-40, 44, 57, 65; 7:16-18, 28-29; 8:16-18, 26-29, 38, 41-42, 54-55; 10:14-18, 25-38; 11:4, 41-42; 12:26-28, 44-50; 13:3, 14:1-21, 26, 28-31; 15:10, 16, 23-27; 16:2-16, 23-24, 27-32; 17:1-26; 20:17, 21, 31). The relationship was succinctly summarized by John the Baptist, who testified that "The Father loveth the Son, and hath given all things into his hand" (Jn. 3:35).

The Latter-day Saints recognize the role of the Godhead in directing the affairs of man, and give full worship and allegiance to God the Father, whom they regard as their God. Joseph Smith taught,

Paul says there are Gods many and Lords many. I want to set it forth in a plain and simple manner; but to us there is but one God--that is pertaining to us; . . . I say there are Gods many and Lords many, but to us only one, and we are to be in subjection to that one, . . . (History of the Church, Vol.6, p.474).

With this position clearly defined and established, let us deal with the question of the existence of other Gods. The following extract from the writings of a well-known Mormon apologist summarizes a portion of the Biblical evidence that many Gods exist:

The BibleTeaches of Many Gods

There are dozens of passages in the Bible that teach that there are many Gods. These passages call for discernment to differentiate them from other passages which make reference to the false gods of the pagan religions which existed in Bible times.

References to false gods speak in a derogatory tone, condemning the practice of idolatry and the sexual excesses of the fertility rites often associated with the worship of those false gods. Those passages often called for repentance, for the renunciation of false-god worship, and for the destruction of the groves and other wicked places of abomination and idolatry. The LORD God of Israel had no association with those false and evil gods, and he called for their overthrow and destruction.

In contrast, there are many passages which speak of Gods who dwell in the presence of the LORD God of Israel, who associate with him, and who have his same objectives and characteristics. The LORD of Israel is depicted as associating with them, and as laboring with and among them. This type of passage is often found in instances of high praise and adoration for God, in situations of worship, in instances of extolling the greatness and goodness of God. They assert the supremacy of Jehovah in the Old Testament, and acknowledge and teach the role of the Godhead in the New Testament. The passages cited below are regarded as examples of Bible passages which teach of a plurality of Gods.

Plural References in God's Speech Consider, for instance, those intriguing passages early in Genesis when one God speaks to another God or Gods, using those intimate words us and our. In the creation account, "God said, Let us make man in our image, after our likeness . . ." (Gen. 1:26).

The account of the fall of Adam and Eve also contains evidences of more than one God. When the serpent tempted Eve, he told her, "Your eyes shall be opened, and ye shall be as gods, knowing good and evil" (Gen. 3:5). Though the serpent attempted to mix falsehood with truth in his comments to Eve, God's statement after the fall confirmed that this portion of the serpent's communication with Eve was correct. After their fall the LORD said, "Behold, the man is hecome as one of us, to know good and evil" (Gen. 3:22).

Again, almost two millennia later, at the time of the tower of Babel, the LORD said, "Let us go down, and there confound their language..." (Gen. 11:7)

These passages all show that there was more than one God participating in the creation, the fall of Adam and Eve, and the confounding of tongues at the tower of Babel.

The LORD Rules Among Other Gods

There are many passages which extol the LORD as a great God who dwells among other Gods. They portray him as being exalted above them and having power and dominion over them. When Moses and the children of Israel sang praises to the LORD they sang, "Who is like unto thee, 0 LORD, among the gods? who is like thee, glorious in holiness fearful in praises, doing wonders?" (Ex. 15:11). Moses also spoke' of, "The LORD your God of gods, and Lord of lords, a great god, a mighty, . . ." (Deut. 10:17).

Joshua exclaimed, "The LORD God of gods, the LORD God of gods, he knoweth, - . ."(Josh. 22:22; see 22:5). Solomon, as he built the great temple, wrote: "The house which I build is great: for great is our God above all gods" (2 Chron. 2:5).

The psalmists repeatedly acknowledged that there are many Gods. Asaph wrote, "God standeth in the congregation of the mighty; he judgeth among the gods" (Ps. 82:1; see Is. 14:13: congregation.") David wrote, "Among the gods there is none like unto thee, 0 Lord; neither are there any works like unto thy works" (Ps. 86:8). Another psalm says, "The Lord is a great God, and a great King above all gods" (Ps. 95:3). And another says, "I know that the LORD is great, and that our Lord is above all gods" (Ps. 135:5). The next psalm proclaims, "0 give thanks unto the God of gods: for his mercy endureth for ever. 0 give thanks to the Lord of lords: for his mercy endureth forever" (Ps. 136:2). Another psalm of David promises, " will praise thee with my whole heart: before the gods will I sing praise unto thee. I will worship toward thy holy temple, and praise thy name. . . "(Ps. 138:1-2).

Others Not of Israel Recognized a Plurality of Gods

Even those who were not of the house of Israel knew that there were "gods" who were involved in Israel's well being. The Philistines, for instance, were frightened when the ark of the covenant was brought into the nearby Israelite camp, and wailed, "Woe unto us! who shall deliver us out of the hand of these mighty Gods? these are the Gods that smote the Egyptians with all the plagues in the wilderness" (1 Sam. 4:8).

The Babylonian king, Nebuchadnezzar, was recipient of the greatest prophetic vision ever revealed to one who wasn't an authorized prophet of God. The vision, revealed by "God in heaven" (Dan. 2:28), showed the future fate of empires and the rolling forth of the Lord's great work. Nebuchadnezzar acknowledged to Daniel that "your God is a God of gods, and a Lord of kings,..." (Dan. 2:47). He spoke of Daniel as one "in whom is the spirit of the holy gods" and told Daniel "I know that the spirit of the holy gods is in thee" (Dan. 4:8-9, 18). His queen also spoke of Daniel as one "in whom is the spirit of the holy gods" and said that he had "wisdom like the wisdom of the gods" (Dan. 5:11). Nebuchadnezzar's son, Belshazzar, also told Daniel, "I hear the spirit of the gods is in thee" (Dan. 5:14) and Daniel reminded him that "the most high God gave Nebuchadnezzar thy father a kingdom, and majesty, and glory, and honour" (Dan. 5:18).

Comparative and Superlative Evidences

Then there are the many passages that utilize comparatives. Many of them speak of the most high God or the highest God, which clearly indicates that there are other Gods which hold stature, but of a lesser degree. See, for instance, Gen. 14:18, 19, 20, 22; 2 Sam. 22:14; Ps. 7:17; 18:13 ,47:2, 50:14, 57:2, 78:56, 82:6, 83:18; 91:9; 92:1,8; and Heb. 7:1. Thus the LORD is Lord of lords (see Deut. 10:17; Ps. 136:3; 1 Tim. 6:15; Rev. 17:14 and 19:16), and King of kings (see I Tim. 6:15; Rev. 17:14 and 19:16).

The LORD Requires Respect for Other Gods

Then there are those passages when God himself speaks to Israel, instructing them how they should show respect to other divine beings, even though they are not those whom the people directly worship. When the LORD revealed his laws unto Moses, he commanded, "Thou shalt not revile the gods, nor curse the ruler of thy people" (Ex. 22:10). And he also cornrnanded, "In all things that I have said unto you be circumspect: and make no mention of the name of other gods, neither let it he heard out of thy mouth" (Ex. 23:13).

Other Gods Identified: Those Who Receive the Word of God

There are still other passages that define who some of the other Gods are. In a psalm of Asaph we read: "I have said, Ye are gods; and all of you are children of the most High" (Ps. 82:6). Jesus quoted this psalm in a confrontation with the Pharisees of his day. They accused him, saying that "Thou, being a man, makest thyself God." Jesus answered them, "Is it not written in your law, I said, Ye are gods? And then he identified those who would be gods as those "unto whom the word of God came" (John 10:33-38).

Joint-Heirs With Christ. His statement aligns closely with the doctrine of heirship which is clearly proclaimed in the New Testament. Paul taught that "The Spirit itself beareth witness with our spirit, that we are the children of God: And if children, then heirs; heirs of God and joint-heirs with Christ; if so be that we suffer with him, that we may be also glorified together" (Ro. 8:16-17). A central promise of the gospel is that the righteous can he joint-heirs with Christ, whom God the Father "hath appointed heir of all things" (Heb. 1:2; Jn. 16:15).

As joint-heirs with Christ, and thus heirs of all things, we can also be a "lord of all" (Gal. 4:1) and realize the full glory of being an "heir of God through Christ" (Gal. 1:7; see also Tit. 3:7, Jas. 2:5, and Eph. 3:6). This helps us understand the full intent of Christ's commandment to "be ye therefore perfect, even as your Father which is in heaven is perfect" (Matt. 5:48). It also helps us to grasp the full meaning of Paul's statement that "I press toward the mark for the prize of the high calling of God in Christ Jesus" (Phil. 3:14-15; Col. 1:28).

This knowledge of the doctrine of heirship also helps us understand who the Gods will be who are instructed to "worship him, all ye gods" (Ps. 97:7) when the Lord comes in glory at the beginning of his millennial reign (see Ps. 97:1-10).

Three Members of the Godhead Govern This Earth

The Bible also contains hundreds of passages which indicate that God the Father, God the Son Jesus Christ, and God the Holy Ghost are all separate, holy, divine beings holding the full status of Godhood. Though separate beings, often seen in or manifested from separate places at the same time (Mt. 3:16-17; Mt. 17:1-5; Jn. 12:28; Acts 7:55-56; Mk. 16:19; etc.), the Bible clearly indicates that they are separate individuals who fulfill separate functions (Jn. 5:17-22, 3O-36; 13:3; 14:26-28; 15:26; 16:5-7; Eph. 2:18; etc.). They are united and agree in purpose, functioning for the benefit of those here on earth as a Godhead.

The apostle John speaks of the three members of the Godhead and their combined mission, saying, "There are three that bear record in heaven, the Father, the Word, and the Holy Ghost: and these three are one, and there are three that bear witness in earth, the Spirit, and the water, and the blood: and these three agree in one" (1 Jn. 5:7-8).

Christ Taught Concerning the GodheadJesus Christ revealed to mankind the nature of the Godhead who rules over this earth. As contrasted with the Old Testament, which repeatedly spoke of many Gods, as is illustrated above, the New Testament, as a result of Jesus's teachings, focuses on the three divine beings who govern this earth: God the Father, his Son Jesus Christ, and the Holy Ghost. The Book of John, especially, contains dozens of passages where the Christ explained his relationship to his Father and to the Spirit.

With the new light which Jesus gave to man concerning the Godhead, New Testament witnesses adopted different terminology, repeatedly identifying God the Father as God, and Jesus Christ as Lord, and identifying the three as having direct rule and responsibility for this earth. Thus Paul wrote of "One Lord, one faith, one baptism, One God and Father of all" (Eph. 4:5-6).

Responsibility for this Earth Delegated to Christ by the Father

The New Testament indicates that God the Father has granted unto Jesus Christ, the LORD, specific and direct responsibility for governing this earth throughout its temporal existence.

Thus Jesus Christ was the executive by whom the Father made this earth (Heb. 1:2; Eph. 3:9). Christ came to the earth in the meridian of time as a mortal being and taught his people. He died on the cross to atone for their sins, broke the bands of death and began the resurrection process, and yet will come at the end of the earth's probationary period to rule and reign during the millennium as King of kings.

It is Christ who is the mediator with the Father (1 Tim. 2:5; Heb. 8:6; 9:15; 12:24). It is Christ whom the Father has set to be over the Church (Eph. 1:22). It is Christ who will judge mankind (John 5:22-23, 27). It is only through belief in Christ that man can attain eternal life (John 3:16). It is only through Christ that man can attain salvation (Jn. 14:6), and it is only through Christ's grace that man can become a God: an heir of God through Christ (Gal. 4:1, 7).

It is this delegation of responsibility for the affairs of this earth that caused Paul to write,

Wherefore God also hath highly exalted him, and given him a name which is above every name. That at the name of Jesus every knee should bow, of things in heaven, and things in earth, and things under the earth;

And that every tongue should confess that Jesus Christ is Lord, to the glory of God the Father (Phil. 2:9-11).

Thus, Christ is LORD!! He is the one and only God for this earth in the sense that he is the Father's executor, and the channel through which all eternal blessings flow to mankind.

The key to understanding the scriptures concerning the nature of God, then, is to recognize (1) that there are, can be, and will be many Gods, (2) that God the Father holds ultimate Godship over all mankind here on the earth, and (3) that Jesus Christ is the Father's representative and executive, with full responsibility for this earth and all its inhabitants. This is exactly what Paul explained in his epistle to the Corinthians:

For though there be that are called gods; whether in heaven or in earth, (as there be gods many, and lords many,)

But to us there is but one God, the Father, of whom are all things, and we in him; and one Lord Jesus Christ, by whom are all things, and we by him (1 Cor. 8:5-6).

Now, let's turn to the matter of the Isaiah passage which was the subject of the question. Isaiah 44:8 is only one of several passages in a four-chapter section of Isaiah which emphatically warns against the evils of idolatry. Others include 43:10-12; 44:6; 45:18, 21, 22; and 46:9. Note the heavy emphasis in these chapters on waming Israel of the dangers of idolatry and rebuking the people for their sins:

1. The Lord saved when there was no strange god among them (43:12).

2. The people wearied the Lord with their iniquities (43:22-24).

3. Thy teachers have transgressed against me (43:27-28).

4. They that make a graven image are all vanity (44:9).

5. They have molten a graven image and worshipped it (44:10-17).

6. Wo to him that striveth with his maker (45:9-10).

7. They have no knowledge that set up the graven image, and pray unto a god that cannot save (45:20).

8. Their idols upon beasts are a burden (46:1-2).

9. A goldsmith makes a god, they fall down and worship (46:6-7).

In this context, the LORD asks Israel to compare him to the idols and false gods (46:5). He emphasizes that the false gods have no power, while it is he who created Israel and covenanted with them to be their God and King. Note particularly:

1. The LORD created Israel (43:1, 7, 15; 44:2, 21, 24; 45:7-8, 12, 18).

2. Israel belongs to the LORD (43:1).

3. The LORD will be with Israel (43:2, 5).

4. The LORD is Israel's king (43:15; 44:6).

5. The LORD will provide Israel water and blessings (43:19-20; 44:34).

6. The LORD is Israel's savior and redeemer (43:11, 14, 24; 45:15,21).

7. The LORD is Israel's God (43:3; 12; 44:6, 8; 45:5; 46:9).

8. The LORD will gather Israel and build Jerusalem (43:5-6; 44:26-28; 45:20; 46:13 ).

With all the passages speaking of many Gods which have already been cited in this chapter, why do these few passages in Isaiah assert that the LORD is the only God, and that there is only one God?

The Israelite nation is described in the Bible many times as a disobedient son, a son who remains faithful to his father only for short periods of time and then looks for another. Moses, for instance, had left the people of Israel while he went to receive God's will on Mt. Sinai, only to return and find them claiming that the God who had delivered them from Egypt was not Jehovah but an idol--a golden bull calf they had built (Ex. 32:4).

This type of scene was multiplied many times over before and after the Israelites reached the promised land. Is it any wonder that the Lord, through his prophets, instructed Israel that for them there was no other God besides Jehovah? Isaiah 44:8 is not a statement delineating how many Gods exist in the eternities, but a statement telling Israel there is no other God over them--no pagan or graven god has power, and only Jehovah can save them.

The monotheistic flavor of the identified verses in these four chapters of Isaiah must be interpreted in the light of the dozens of passages cited above which give clear evidence of a plurality of Gods. Obviously, these chapters were intended as extra-strong statements about the role of Jehovah as Israel's God to combat the pernicious idolatry which had gripped the nation. Taking those few verses alone, outside of the context of the entire Bible, leads to a false understanding of the nature of God.

For the third time in my life, the Social Security System will go belly-up.

The first time was in 1977 – well, almost. To head off the bust, Jimmy Carter got Congress to pass a major FICA tax increase – sorry, "contribution" increase – in order to save Social Security. The rate would be hiked in phases from 2% to 6.15% (times two: employee and employer). He promised: "Now this legislation will guarantee that from 1980 to the year 2030, the Social Security funds will be sound."

Carter's projection was off by a Georgia country mile. In 1983, the SSA program technically went bankrupt. Reagan signed a law that speeded up Carter's rate increases, added Congressional employees to Social Security, and delayed the age of eligibility.
Unless there is another Social Security tax increase in 2010, the system will go into red ink mode and stay there.

The public has not been informed of this, which comes as no surprise. There have been a few scattered stories on the Web, but nothing sustained. The media do not want to admit that the jointly operated Social Security program and Medicare program are going to bankrupt the Federal government if they are not cut back drastically.

They are never cut back. They always expand.

Medicare's Hospital Insurance program has been in red ink mode for two years. The public does not know this, either. To cover the program's insolvency, the government is quietly funding the Hospital Insurance Trust Fund with bailouts from the general fund.

Politically, this creates a problem. When the Treasury taps the general fund, the expenditure appears on the budget – the on-budget budget – as an expenditure. This immediately adds to the deficit, meaning the visible deficit, the one that gets recorded on those wonderful U.S. debt clocks.

When revenues flow into the four Social Security and Medicare trust funds, the money is instantly handed over to the Treasury, which issues non-marketable long-term IOU's to the trust funds. These IOU's are listed as assets by the funds. But, through the wonders of government accounting, they are not listed as liabilities on the government's on-budget budget. They are liabilities only on the off-budget budget, which most Americans are unaware of. This chicanery has been going on ever since the Johnson Administration (Lyndon's, not Andrew's).

The problem facing the politicians is this: when a trust fund is no longer showing a surplus of revenues over expenditures, it has to sell its assets back to the Treasury. The Treasury's non-listed liabilities must be converted into money to send to the legal recipients. This is a red alert of hidden red ink. The public finds out. The debt clocks speed up.
The Treasury has no money in reserve. Every dollar that it takes in immediately flows out. So, it must get Congress to provide the money for the deficit-running trust funds, either by taxing or by borrowing (increasing the legal debt ceiling).

What's a Congress to do?


The Congressional Budget Office released a report in July on the condition of the Social Security trust finds. There are two funds: Old Age Insurance and Disability Insurance. Think of them as "geezers and gimps." Combined, they are called OASDI. The report offered a table of numbers showing inflow and outflow. It is here.

The table is tricky to interpret. This is deliberate. The political strategy has always been concealment. But if we think through what is being reported in this table, we can spot the ringer.

The ringer is interest payments to the trust funds. The Treasury issued the IOU's, so it must pay the trust funds interest.

Think: "Where does the Treasury get the money?"

Answer: "The general fund." Up go the debt clocks.

Look at the figures projected for 2009. Income from revenues (FICA) is $653 billion. Total income is $808 billion. Where did the extra income come from? Three sources.

Taxes on benefits: $21 billion

Federal employer share: $14 billion

Interest: $120 billion

This means that the U.S. government has to pony up an extra $134 billion to pay to itself: $14 billion in taxes paid on behalf of Federal workers plus $120 billion in interest. This is counted as revenue for the OASDI Trust Fund, but it is red ink for the government.


Now let's do a reality check. Subtract $134 billion from the $808 billion reported as total income to the OASDI Trust Fund. Why subtract it? Because this is not income coming from outside the government. We get $674 billion.

What is the expected outgo? $670 billion. The official budget surplus for the OASDI Trust Fund: $138 billion ($808b minus $670b). This is reported by the CBO under "Surplus." This looks pretty good. For the Trust Fund, it is pretty good.

For the government, the real figure is barely in the black. The official on-budget, count-the-subsidy-as-a-subsidy OASDI surplus for the U.S. government: $4 billion ($674b minus $670b).

This is never mentioned by the CBO. We are expected to figure this out. No one does. It took me several minutes to spot the ringer.

Now let us look at the projections for 2010. Income for the trust funds: $811 billion.

Taxes on benefits: $20 billion

Federal employer share: $15 billion

Interest: $118 billion

Let us remove the U.S. government's payments into the fund: $133 billion ($15b + $118b). This must be covered by the general fund. Subtract this from total income to the OASDI fund: $811b minus $133b = $678b.

The expected outgo is $703 billion.

The deficit for the OASDI program in 2010 will be $25 billion ($703b minus $678b).

Some people will regard the "Federal employer share" as non-subsidy: $15 billion. I'll concede this in practice, although I still think this is money extracted by taxes paid into the general fund. Even with this money removed, Social Security will run a $10 billion deficit in 2010.

Social Security will go bust in 2010, if CBO projections are correct.

What do I mean by "bust"? I mean technically insolvent – you know, like the nation's biggest banks in September 2008, before the government's bailout and the Federal Reserve's swap at face value of T-bills for toxic debt held by the banks.

I mean by "bust" the inability of the Social Security System to pay its bills by means of money extracted from the public by way of FICA "contributions."

Think of the Social Security System as Oliver Twist in the workhouse, gruel bowl in hand. "Please, sir, may I have some more?" Unlike Bumble, the Treasury dips its ladle into the gruel and then fills up the bowl. For how long? Tomorrow and tomorrow and tomorrow.


The accounting scam of the Social Security Trust Fund has worked politically for a generation. It is not just the voters who are fooled. The best and the brightest in the media have been taken in. Here is an exchange that took place on the PBS show, Nightly Business Report, on March 25, 2009.

GERSH: A negative cash flow does not mean Social Security is in crisis. The program has built up an enormous trust fund over two decades. Barbara Kennelly is president of the Committee to Preserve Social Security and Medicare. She says the trust fund is more than enough to cover any short-term financial hit.

BARBARA KENNELLY, PRES., NATIONAL COMMITTEE TO PRESERVE SOCIAL SECURITY & MEDICARE: The trustees look at it every single year, the report is going to come out at the end of this month. And you're going to still see that we can pay those benefits way out. Say it's not 2041, it's 2040 or 2039. But we have that money. There is $2.5 trillion in the trust fund for Social Security.

No problem! There is a $2.5 trillion asset base. The OASDI Trust Fund need only sell a few of these assets each year.

The interviewer with PBS never batted an eye. He did not say, "Don't try to pull the wool over my eyes, sister. I wasn't born yesterday." Yes, he was, and the scam worked just as well yesterday as it does today.

She said: "We can pay those benefits way out." How? By selling trust fund assets.

You know the old line from the financial world. "Sell!" "To whom?"

To sell an asset, there must be a market. Here is the punch line, taken directly from the 2009 Report of the Trustees: "Status of the Social Security and Medicare Programs." (In a printout, this appears on page 4.)

The Department of the Treasury invests program revenues in special non-marketable securities of the U.S. Government on which a market rate of interest is credited. The trust funds represent the accumulated value, including interest, of all prior program annual surpluses and deficits, and provide automatic authority to pay benefits.

What, exactly, are "non-marketable securities"? They are IOU's issued by the Treasury on behalf of the U.S. government. As I mentioned, these IOU's are not recorded in the government's on-budget account. The revenues that purchase these IOU's are.

But wait! There's more! Pay attention to these words: "on which a market rate of interest is credited." The Treasury applies a market rate of interest to a non-marketable security. There is no such rate. The Treasury can make it up as it goes along.

So, the trust funds are filled with assets: non-marketable IOU's from the government, issued  a government agency. The trust funds are treated as marketable assets. They are indeed marketable: to the Treasury. The bill is passed along to Congress whenever the trust fund sells any of these assets.

There are lots and lots of these IOU's in the Social Security OASDI Trust Fund. No problem!This is a scam. It is an accounting trick to deceive the public. Does it work? Better than Congress could have dreamed back in late 1968, when the change in accounting took place.

According to the lady representing the special interest group promoting Social Security and Medicare, Judgment Day is a depleted trust fund. That will take place is 2040, give or take a couple of years. Politically, a date this far out is irrelevant. Congress has been playing kick the can on this issue for a generation. There is no sense of urgency by the public, so there is no sense of urgency in Congress.

Judgment Day is 2010, when the general fund must start paying for those cashed-in non-marketable assets.

Let's see if Congress will kick the can some more. Let's see if Congress passes hikes in the FICA tax rates in 2010, or extends the wage base that pays the tax beyond today's $106,800 limit. My guess: Congress will kick the can. The deficit will grow.


Those were Ed McMahon's four words to Johnny Carson, decade after decade, setting up Carson's punch line.

Here is the punch line – lines, actually – as delivered by the notoriously humorless trustees of the Social Security and Medicare Trust Funds.

The 2009 report begins: "The financial condition of the Social Security and Medicare programs remains challenging." I worked on Capitol Hill as Ron Paul's first research assistant back in 1976. The code word "challenging" means "politically unsolvable at the present time, so Congress will kick the can."

To this assessment, add the first sentence in the Conclusion: "The financial difficulties facing Social Security and Medicare pose serious challenges." What does "serious challenge" mean? Think of December 7, 1941, on board the U.S.S. Arizona. Imagine this sound: "Aye-oo-ga! Aye-oo-ga! Abandon ship! Abandon ship!"

We are assured that Social Security's problem is merely difficult. ("Yellow alert! Yellow alert!")

For Social Security, the reform options are relatively well understood but the choices are difficult.

The Social Security options are very well understood by Congress, but not the public.

These options have been understood by Congress ever since 1983, when Reagan hiked FICA taxes.The political choice was difficult in 1983, back when Reagan still thought he could balance the budget without vetoing spending bills sent up by Congress, which he usually signed into law. That was the year that the on-budget deficit hit $200 billion, a year before my 1977 prediction that it would hit $200 billion in 1984.

Reagan knew that red ink from the sale of Social Security Trust Fund assets back to the Treasury would push his on-budget budget even deeper into the red. He hiked FICA taxes to keep this from happening. Ever since then, Congress has played kick the can.

We ain't seen nothin' yet! The Conclusion concludes:

Medicare is a bigger challenge. Its cost growth can be contained without sacrificing quality of care only if health care cost growth more generally is contained. But despite the difficulties – indeed, because of the difficulties – it is essential that action be taken soon, particularly to control health care costs.


We are on board a replica of a 19th-century Mississippi paddle wheel steamboat. Nostalgia is always popular. The illusion of the good old days still sells. The engine is chugging faster and faster. The captain and crew decided long ago never to put the engine into reverse.

We are floating down the fiscal river of no return. We are moving faster and faster. Some of us can hear the falls ahead. The sound gets louder and louder. But our companions on board say, "Let's party!" They head for the dining room. After that, they will head for the slot machines.

Americans respond favorably to these words: "Free" and "all you can eat." That is what politicians promise.

Either the falls will get us (deflationary depression) or else an explosion of the overheated engine will (hyperinflation).

Our companions are still in the dining room or heading toward the slot machines. You and I should begin to move toward the lifeboats.
